Terms of use
Draft — not yet reviewed by a lawyer
This page is a structure with the details still to be filled in. Anything shown like [THIS] is a blank the owner of the business has to complete, and the wording has to be checked by an Australian legal adviser before it means anything. Until then, please do not rely on it.
Who you are dealing with
This product is supplied by [REGISTERED ENTITY NAME], ABN [ABN], of [REGISTERED BUSINESS ADDRESS].
Your account
You need an account to use the product. Keep your password to yourself, and tell us if you think someone else has it. You can change your password on your settings page.
The rules about who may use an account, and what happens if they are broken, are to be set out here: [ACCEPTABLE USE AND SUSPENSION TERMS].
What this product does not promise
This is decision support, not a decision. Grazing days, carrying capacity and water adequacy are estimates built on measurements you supply and on published Australian figures. They carry a real error band, which is why the product shows a range instead of a single number.
Where a figure cannot honestly be worked out — no pasture assessment, no paddock area, no mob recorded, no observed water level — the product says which piece is missing and stops. It does not fill the gap with an assumption.
Water quality cannot be judged from the air. Salinity, pH, nitrate and bacteria have no optical signature at the concentrations that matter, so they only ever appear here from a laboratory result you have had done.
Destocking, agistment, mustering and animal welfare decisions remain yours. Check the country before you act on a number.
Paying for it
Plans, prices and billing periods are shown on the billing page and are handled by Stripe.
Renewals, cancellation and refunds are to be set out here: [BILLING, RENEWAL, CANCELLATION AND REFUND TERMS]. Nothing in them can take away the guarantees you have under Australian Consumer Law.
Your records are yours
What you record about your station belongs to you. We store it to run the product for you. You can download all of it, or close your account and have it removed, from your settings page. How we handle it is described on the privacy page.
The licence you grant us to store and process it is to be set out here: [CUSTOMER DATA LICENCE TERMS].
Availability
What we commit to on uptime, planned maintenance and support response is to be set out here: [SERVICE AVAILABILITY AND SUPPORT COMMITMENTS].
Liability and warranties
To be drafted by an Australian legal adviser: [WARRANTY AND LIABILITY TERMS, CONSISTENT WITH AUSTRALIAN CONSUMER LAW].
Nothing has been written into this section yet. Do not treat its emptiness as a limit on anyone’s rights or obligations.
Ending the agreement
You can close your account at any time from your settings page. The notice we must give you, and what happens to your records afterwards, are to be set out here: [TERMINATION AND DATA RETURN TERMS].
Which law applies
These terms are governed by the law of [STATE OR TERRITORY], Australia, and disputes go to the courts of [JURISDICTION].
Changes to these terms
How we tell you about changes, and how much notice you get, are to be set out here: [VARIATION AND NOTICE TERMS]. Last updated: [DATE OF LEGAL REVIEW].
